Welcome to Flashtech Lighting! These Terms of Service ("ToS" or "Terms") govern your access to and use of the Flashtech Lighting application, website, or related services (collectively, the "Service"), provided by Flashtech LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.
1. Acceptance of Terms
1.1 General Agreement: By using the Service, you represent that you have read, understood, and agree to these Terms, as well as any additional policies referenced herein, including our Privacy Policy.
1.2 YouTube Terms of Service: Flashtech Lighting utilizes YouTube API Services to deliver certain functionalities. By using the Service, you agree to be bound by the YouTube Terms of Service, which are incorporated into these Terms by reference. Please review them carefully.
2. Eligibility
2.1 Age: You must be at least 13 years old to use the Service. If you are under 18, you represent that you have the consent of a parent or legal guardian to use the Service and agree to these Terms.
2.2 Authority: If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

5.2 YouTube API Data: When you use features powered by YouTube API Services, we handle data in accordance with YouTube’s policies. We do not store or display YouTube API data (whether authorized or non-authorized) for more than 30 days, unless explicitly permitted by YouTube. Any data stored beyond this period will be deleted promptly to comply with YouTube API guidelines.
6. Intellectual Property
6.1 Our Rights: The Service, including its design, code, trademarks, logos, and content (excluding User Content), is owned by Flashtech LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws.
6.2 User Content: You retain ownership of any content you upload or create through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display it as necessary to provide the Service.
6.3 Feedback: If you provide us with feedback or suggestions about the Service, we may use them without obligation to you.
7. Third-Party Services
7.1 Integration: The Service may integrate with third-party services, such as YouTube API Services. Your use of these third-party services is subject to their respective terms and policies (e.g., YouTube Terms of Service).
7.2 No Endorsement: We do not endorse or control third-party services and are not responsible for their availability or performance.
8. Modifications to the Service and Terms
8.1 Service Changes: We may update, modify, or discontinue the Service (or any part thereof) at our discretion, with or without notice.
8.2 Terms Updates: We may revise these Terms at any time. Changes will be posted here with an updated "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
9. Termination
9.1 By You: You may stop using the Service at any time.
9.2 By Us: We may suspend or terminate your access to the Service if you violate these Terms, engage in illegal activity, or for any reason at our sole discretion, with or without notice.
9.3 Effect of Termination: Upon termination, your license to use the Service ends, and we may delete your data, subject to applicable laws.

11.1 Exclusion: To the fullest extent permitted by law, Flashtech LLC, its affiliates, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages.
11.2 Cap: Our total liability to you for any claim related to the Service will not exceed $100 USD.
12. Indemnification
You agree to indemnify and hold Flashtech LLC, its affiliates, officers, employees, and agents harmless from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
13. Governing Law and Dispute Resolution
13.1 Law: These Terms are governed by the laws of Louisiana, USA, without regard to conflict of law principles.
13.2 Disputes: Any disputes arising from these Terms will be resolved through binding arbitration in Metairie, Louisiana, except for matters that may be taken to small claims court. Arbitration will be conducted under the rules of the American Arbitration Association (AAA).
14. Miscellaneous
14.1 Entire Agreement: These Terms, along with the Privacy Policy and any other referenced policies, constitute the entire agreement between you and us regarding the Service.
14.2 Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
14.3 No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
